Facts

The London Borough of Harrow brought public law proceedings in the Family Court concerning child A. The proceedings, begun in the Family Court, were transferred by order of MacDonald J to be heard by a High Court Judge sitting in the Family Court because of their complexity, and have been case managed by McKendrick J since late 2025. The First Respondent is child A's mother, whose whereabouts are unclear, believed to be in southern Asia, and who has played no part in the proceedings. The Second and Third Respondents are X and Y, said to be the child's Great Aunt and Great Uncle; the child is joined as a party and represented by her Cafcass Guardian. The local authority's final threshold document, dated 24 February 2026, alleges that the Second and Third Respondents trafficked child A to the United Kingdom in 2021, giving false accounts and supplying fabricated birth, adoption and medical documentation identified as false by the National Document Fraud Unit, and that child A was subjected to domestic servitude and physical abuse. Those allegations are denied. At a case management hearing in April 2026 the judge made a disclosure order against the Metropolitan Police, which responded with a without notice application on Form C2 asserting public interest immunity over the material.
