BB v The Secretary of State for the Home Department

Facts

The appellant, BB, is a national of Jamaica who is subject to an anonymity order. The Secretary of State for the Home Department refused his protection and human rights claims by a decision dated 29 May 2026, and he lodged this appeal to the First-tier Tribunal (Immigration and Asylum Chamber) on 15 June 2026. The Secretary of State relies upon his convictions for serious sexual offences against a child, for which he received an aggregate sentence of 16 years' imprisonment in March 2014, and has certified the protection claim under section 72 of the Nationality, Immigration and Asylum Act 2002. He also relies upon Articles 3 and 8 of the European Convention on Human Rights. An earlier appeal concerning his proposed deportation was dismissed by the First-tier Tribunal in a decision promulgated in August 2022, the findings in which are to be the starting point for the tribunal determining this appeal. The refusal decision refers to a deportation order dated 16 February 2021. The matter came before Tribunal Judge Aspinall at a case management review conducted by CVP, at which the appellant appeared in person, unrepresented and without an interpreter, and the Secretary of State was represented by a Home Office Presenting Officer. The appellant had been released from custody but the tribunal record still showed him as detained at his former prison address, and he had not received the respondent's bundle.
