Christopher Shaw v Coleman Capital LLP (in Liquidation) & Ors

Facts

The claimant, a chartered surveyor and businessman now living in Gibraltar, placed about £17.5 million with the first and second defendants between September 2020 and April 2024, via Jones & Partners Ltd and then Linear Investments Ltd, a prime broker. The money was to be invested in the Coleman funds, with about £800,000 of equities transferred as the KH Assets, and £13 million to be placed in a LIBOR deposit. The first defendant, Coleman Capital LLP, went into liquidation in August 2025 and the second defendant, Mr McClean, was bankrupt from 12 August 2025 to 12 August 2026. The third defendant is a Gibraltar company controlled by the second defendant. Nothing has been returned. The claimant issued a Part 7 claim on 29 April 2025 after Trower J had granted freezing and proprietary injunctions on 24 April 2025. His claim included fraudulent misrepresentation, conspiracy, breach of fiduciary duty and dishonest assistance. None of the defendants filed an acknowledgment of service or defence, although the second defendant filed an affidavit, a witness statement and a skeleton argument. By notice dated 1 May 2026 the claimant applied for summary judgment on the two deceit claims only. No defendant attended the hearing on 21 July 2026.
