Clive David Carter v London Borough of Haringey

Facts

The applicant, Clive David Carter, had appealed to the First-tier Tribunal against a decision of the Information Commissioner concerning four requests for information made to the London Borough of Haringey (case no EA/2023/0217). The Tribunal's decision of 8 January 2025 substituted a decision notice requiring the council to disclose appropriately unredacted versions of the Carter Jonas LLP report and of the information caught by the second and fourth requests within 35 days, while dismissing the appeal as regards the third request. The council had not been a party to that appeal — earlier applications to be joined, by email of 20 May 2024 and by GRC5 form of 7 June 2024, having been refused — but it applied on 5 February 2025 for permission to appeal and to be joined. On 11 February 2025 it was joined as Second Respondent and the substituted decision notice was suspended. Judge Heald refused permission to appeal to the Upper Tribunal on 7 March 2025 and extended time for compliance to 4pm on 7 April 2025. No direct application to the Upper Tribunal followed. The applicant notified the Tribunal of non-compliance on 17 April 2025 and applied on 23 April 2025 to certify a contempt. The council disclosed on 24 April 2025, 17 days late.
