Facts
The appellant, Farid Karemi, applied to the Registrar of Approved Driving Instructors for a third trainee driving instruction licence, enclosing a letter of representations dated 27 February 2026. By a decision dated 2 April 2026 the Registrar refused the application, having taken the representations into account. The appellant appealed to the First-tier Tribunal (General Regulatory Chamber). By an application dated 24 September 2026, copied to the appellant, who sent no reply, the Registrar asked for the appeal to be struck out. The Registrar's ground was that under regulation 14(b) of the Motor Cars (Driving Instruction) Regulations 2005 a trainee licence can remain in force only until the day immediately following the holder's third unsuccessful attempt at the Part 3 test, and the appellant had failed that test for the third time on 24 September 2026. The application was dealt with by Judge McMahon as a case management decision under the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009.
