Gopichand Parmanand Hinduja (Deceased) v Vinoo Srichand Hinduja & Anor

Facts

The application arose from a long-running feud within the Hinduja family, which led the multinational Hinduja Group. Srichand Hinduja (SP), the eldest of four brothers, signed a lasting power of attorney for property and financial affairs in June 2015, nominating his wife Madhu as attorney and his daughters Vinoo and Shanu (V&S) as replacements. A year earlier SP and his brothers had signed a document known as J14, concerning control of the family assets, which spawned Chancery proceedings begun in November 2019 seeking declarations that it had no legal effect. In June 2020 SP's brother GP began Court of Protection proceedings questioning SP's capacity to make the LPA and the management of his affairs. A transparency order followed in July 2020, and by an order of Cohen J in February 2021 the court waived privilege on SP's behalf, for the limited purpose of use in the Court of Protection proceedings, in two schedules of documents: the Scheduled Main Documents, whose disclosure was additionally conditional on strict Express Undertakings, and the Scheduled LPA Documents, which were not. SP died in May 2023 and GP in November 2025. GP's son Sanjay now sought to deploy documents disclosed in those proceedings in Jersey trust proceedings concerning the Acorn Trust and in contemplated probate proceedings over SP's competing 1992 and 2016 wills. The application, transferred from Hayden J, was heard by Mrs Justice Bacon.
