Facts
The claimant, Green Lane Association Limited (GLASS), challenged a traffic regulation order made by the defendant, Oxfordshire County Council, on 22 June 2026: the Oxfordshire County Council (East Challow, Cornhill Lane BOAT Nos. 196/3/10, 30 & 40) (Prohibition of Motor Vehicles and Carriages) Order 2026. Cornhill Lane is an unmetalled byway open to all traffic in rural Oxfordshire, over which the public enjoy a right of way by all means, including motorised vehicles, running from its junction with the A417 Faringdon Road to the north to its junction with the B4507 Ickleton Road to the south. The Order purported permanently to prohibit the use of motor vehicles and horse drawn carriages with four or more wheels and any that are wider than 1.5m. On 14 July 2026 the claimant's solicitors, Richard Buxton Solicitors, wrote to the council setting out four grounds of challenge. On 24 July 2026 the council replied that it would be prepared to consent to the quashing of the Order. The claim was made under paragraph 35 of Schedule 9 to the Road Traffic Regulation Act 1984. The parties agreed a statement of reasons and a consent order, which the court considered on the papers.
