J's Supermarket Limited, R (on the application of) v The Secretary of State for the Home Department

Facts

J's Supermarket Limited, a medium-sized South Asian grocery business in Tooting run by its director Mr Jalatheepan Ramachandran, was granted a sponsor licence on 16 January 2023 and issued certificates of sponsorship to Naveen Chandrasekaran and Manoj Chandrasekar in 2023. A Home Office compliance visit on 9 May 2024 found that the duties the workers described bore little resemblance to the managerial job descriptions on their certificates. The licence was suspended on 22 August 2024; Mr Ramachandran was abroad and did not respond, and the licence was revoked on 10 October 2024, a reconsideration on 12 November 2024 upholding revocation. Prestige Social Care Services Ltd, a care provider whose director was Faith Chipatiko, had its licence suspended on 26 March 2024 over disproportionate certificate volumes, high attrition and recruitment irregularities, including the recruitment of Ms K to a role requiring driving although she had declared she could not drive, and of Mr F, who failed the English language test. Its licence was revoked on 15 October 2024. Both claims for judicial review failed: J's Supermarket's before Duncan Atkinson KC sitting as a Deputy High Court Judge on 25 July 2025, and Prestige's before His Honour Judge Tindal sitting as a Judge of the High Court on 11 November 2025. Both appealed; the Secretary of State cross-appealed in Prestige.
