Kay & Dan's Daycare v Ofsted

Facts

The appellant, Kay & Dan's Daycare, is a small provider registered since 2022 to provide childcare at a non-domestic setting with around 20 children on the roll. It appears to be run by Ms Baker, the nominated individual, and her husband Mr Baker, the deputy manager and a designated safeguarding lead. On 12 June 2026 two members of staff reported to Ofsted that Mr Baker had placed a blanket over a three-year-old child's head and "straddled" the child to make the child sleep. On 16 June 2026 Ofsted suspended the appellant's registration for six weeks, to 27 July 2026, under the Childcare (Early Years and General Childcare Registers) (Common Provisions) Regulations 2008. Ofsted also took account of earlier unsubstantiated allegations involving the Bakers and of a 2026 outcome summary about the handling of an allegation against another staff member. On 19 June Ms Baker asked Ofsted to lift the suspension, citing Mr Baker's own suspension and other measures, and Ofsted maintained its position. The appellant, acting without legal representation, appealed under regulation 12 of the Childcare (Early Years and General Childcare Registers) (Common Provisions) Regulations 2008, also challenging the refusal to lift the suspension. At the appellant's request, and with Ofsted's consent, the appeal was decided on the papers without attendance by the parties.
