Facts

The claimants, Kenneth Alexander and Lee Feldman, are former directors of Entain plc, which from about January 2011 ran an online gambling business directed in one respect at people in Turkey and, in November 2011, reached a business-to-business arrangement with another Turkish online gambling business. Non-state sponsored gambling being illegal in Turkey, the company arranged its affairs on a "point of supply" basis so that operations in the jurisdictions where its servers were located, such as Malta, complied with local law, and it took legal advice from Addleshaw Goddard LLP on the key point of supply issues. In 2019 HMRC served a production order and the company was investigated for potential offences, including under the Bribery Act 2010; in 2023 it entered a deferred prosecution agreement with the Director of Public Prosecutions, approved by the President of the King's Bench Division, Dame Victoria Sharp, sitting in Southwark Crown Court. The claimants issued this claim in February 2025 seeking declarations that the solicitors also acted for them, or that the advice was not privileged as against them, together with delivery up of that advice; both defendants deny the claim. In August 2025 the claimants were charged with conspiracy to defraud and conspiracy to bribe. This was the costs and case management conference.
