Lendinvest Security Trustees Limited v Granville Property Solutions Limited & Anor

LendInvest Security Trustees Limited, the claimant, is part of a lending group. On 10 May 2022 another group company, LendInvest Developments Suffolk Limited, lent money to Granville Property Solutions Limited (the Company). That loan was secured by a charge over development land known as Plot 4, Barrow Hill, Sudbury, on which a house was later built. On 9 November 2022 the Company acquired an adjoining paddock north-east of Clay Hall Lane, Acton, Sudbury (the Property). It appears to have bought the Property to improve the amenity of Plot 4, but it was not registered as proprietor until 20 March 2025. On 24 March 2023 the Company granted the claimant a debenture. This contained a floating charge and a fixed charge over any freehold, leasehold or commonhold interest the Company then held or later acquired. The loan term ended in May 2025, and a formal demand for repayment followed on 27 March 2026. On 13 April 2026 the claimant applied for a unilateral notice against the Company's title. Mr Ian Yeldham claims that the Company transferred the Property to him under a transfer dated 27 April 2026, to discharge its debt for a £100,000 advance he made on 22 December 2023. By an Application Notice dated 21 May 2026, the claimant sought the appointment of receivers over the Property. At a hearing on 19 June 2026 the application was adjourned so that Mr Yeldham could be joined as second defendant. Neither defendant attended the adjourned hearing.
