Lukasz Chromczuk & Ors v Polish Judicial Authority

Facts

Three Polish nationals — Lukasz Chromczuk, Szulejewski and Artur Kowalski — sought permission to appeal against orders for their extradition to Poland. Mr Chromczuk was sought on a conviction warrant issued on 30 May 2025 and certified on 16 July 2025, following a six-year sentence imposed on 11 October 2018 for two offences of rape, false imprisonment and one offence of perverting the course of justice committed in April 2017. Mr Szulejewski was sought on a conviction warrant issued on 14 August 2024 and certified by the NCA on 21 October 2024 in respect of a fraud by false representation, his company having taken approximately £23,000 of salmon products without paying; a two-year sentence remained partly unserved. Mr Kowalski was sought on an accusation warrant issued on 11 June 2025 and certified on 12 June 2025 alleging money laundering of €173,341 obtained by fraud and participation in an organised crime group. Each sought to amend to argue that Polish prison conditions gave rise to a real risk of ill-treatment, relying on a decision of the Schleswig-Holstein Higher Regional Court of 13 May 2026 refusing extradition to Poland, together with reports of the Polish national preventive mechanism, and sought prior authority to instruct a prisons expert. Renewal hearings took place on 30 June 2026 and 22 July 2026 before Foster J.
