Facts
The Appellant, Mohammed Riaz, appealed to the First-tier Tribunal (General Regulatory Chamber) against the Registrar of Approved Driving Instructors. The appeal concerned his application for a third trainee licence. Under Regulation 14(b) of the Motor Cars (Driving Instruction) Regulations 2025, a trainee licence stays in force until the day immediately after the trainee's third unsuccessful attempt at the instructional ability test. While the appeal was pending, the Registrar used a form GRC5 dated 20 August 2026 to tell the Tribunal that the Appellant had failed his third attempt at that test on 19 August 2026. The Registrar said that the Appellant was therefore no longer eligible to hold a trainee licence, that the appeal must fail, and asked for it to be struck out. On 1 September 2026 the Tribunal directed the Appellant to explain by 15 September why the appeal should not be struck out. By email the same day, the Appellant said that he had failed the part 3 test and wished the appeal to be removed. The matter was decided without a hearing.
