Facts
The Tees Valley Islamic and Cultural Association is an unincorporated registered charity founded in 1985, running the Masjid-E-Nomira mosque and associated buildings at 44-46 Middlesborough Road, South Bank, Middlesborough. After Friday prayers on 28 April 2023 there was an altercation at the mosque involving the claimants and certain of the first to tenth defendants or persons connected with them; who started it and why is hotly contested, and the police investigated but took no further action. By letters dated 2 May 2023 the two claimants and seven others were suspended from entering the mosque as an emergency measure. Following internal procedures, the suspensions of the other seven were lifted but the claimants were expelled from membership, purportedly under the charity's constitution. They wished to bring injunctive and declaratory proceedings challenging the lawfulness of their expulsion, which it was common ground were "charity proceedings" requiring authorisation under section 115 of the Charities Act 2011. Earlier proceedings issued in 2024 were struck out, as were an October 2025 application and a further application in November 2025 proceedings. The Charity Commission refused an order by letter dated 15 September 2025, and the claimants applied to the High Court, out of the 21 days allowed by CPR PD 64.6, for permission and for an extension of time.
