Mourad Ayadi v The Secretary of State for the Home Department

Facts

The appellant, Mourad Ayadi, is a citizen of Algeria who says he arrived in the United Kingdom on 14 June 2002, entering illegally by lorry. He first came to the attention of the authorities on 8 September 2017, when he was served with notice of his liability to removal, and he was detained under immigration powers on 24 February 2023, when he was served with such notice again. On 26 May 2023 he applied for leave to remain on human rights grounds, relying on his long residence. The Secretary of State refused the application on 24 October 2024. She took the view that his presence was not conducive to the public good under paragraph S-LTR.1.6 of Appendix FM of the Immigration Rules because he had used a false French ID card in an identity not his own; that he had not produced sufficient documentary evidence of 20 years' continuous residence; that his documents were inconsistent with his statements; that he would face no very significant obstacles to integration in Algeria; and that his removal would not give rise to unjustifiably harsh consequences. The appellant appealed to the First-tier Tribunal, relying on Appendix Private Life and, in the alternative, on article 8 of the European Convention on Human Rights outside the Rules. He, his brother and an interpreter attended the hearing at Taylor House.
