Nashwan Ahmed Abdulnoor Ghilan v Registrar of Approved Driving Instructors

Facts

The appellant, Mr Nashwan Ahmed Abdulnoor Ghilan, has never been on the Register of Approved Driving Instructors. He was granted a trainee licence under section 129 of the Road Traffic Act 1988 to gain practical experience before undergoing the examination of his ability to give instruction in the driving of motor cars, valid from 28 July 2025 until 27 January 2026. On 18 January 2026 he applied for a second licence. He was notified that the Registrar was considering refusal, and he made representations, explaining that he had been involved in a road traffic accident on 29 January 2026 and was in consequence unable to put his training into practice or to submit documentation on time. The Registrar refused the application, finding that he had failed to comply with the conditions of his first licence because the training objectives on his ADI 21AT training record were not completed within the first three months of the licence period, the evidence supplied relating to a later period; the Registrar added that he had already had six months under licence, that he had failed the instructional ability test once, and that a licence was not needed to sit that test. The appellant appealed to the First-tier Tribunal, contending that the decision contained factual errors and that his delay was due to medical incapacity following the accident.
