Pristine Health Solutions Limited v Care Quality Commission

Pristine Health Solutions Limited, whose director is Dr Irvine Mangawa, has been registered with the Care Quality Commission since 18 June 2024 to carry on the regulated activity of personal care from premises in Middleton, Manchester. It was common ground that, since registration, it has never carried on that activity. On 14 August 2025 the CQC asked the company to confirm the status of the activity, and on 19 August 2025 the company confirmed that it had not provided personal care since registration. The CQC issued a notice of proposal to cancel registration on 6 October 2025 and, after representations, issued a decision to cancel on 21 November 2025. The company applied to the First-tier Tribunal on 15 December 2025, appealing under section 32 of the Health and Social Care Act 2008. Dr Mangawa represented the company and gave oral evidence. He said that the company had retained a registered manager, governance arrangements and insurance, and had actively sought care packages through the commissioning routes of Liverpool, Rochdale, Tameside and Stockport, and through private referral platforms. The CQC, represented by counsel and calling Fiona Bryan, its Operations Manager, said that the company had been dormant for more than twelve months and that cancellation was reasonable and proportionate. The appeal was heard remotely on 23 September 2026.
