R v Riad Mushrafi

Facts

The applicant, Riad Mushrafi, was a serving prisoner who came to be sentenced in the Crown Court at Northampton before His Honour Judge David Herbert KC for his conduct towards two female prison officers. He grabbed the buttocks of one officer, and was charged with sexual assault, to which he pleaded guilty; he was sentenced to six months in custody for that offence. In relation to a second officer, he asked for a sexually graphic handwritten letter to be given to her and then spoke to her about masturbating over her and giving her orgasms; he pleaded guilty to a charge of harassment and was sentenced to two months in custody, consecutive to the six-month term. The total sentence of eight months' imprisonment was ordered to be served consecutively to the sentence he was already serving. He sought permission to appeal against sentence, together with an extension of time in which to do so, the grounds being, in summary, that he had used no force or restraint but only words and/or notes. The single judge refused permission, and the applicant renewed the application to the full court, which heard it as a non-counsel application. The Sexual Offences (Amendment) Act 1992 applies.
