Savace Limited v Care Quality Commission

Savace Limited was registered with the Care Quality Commission as a service provider for the regulated activities of accommodation for persons who require nursing or personal care and treatment of disease, disorder or injury at Bramcote Hills Care Home in Bramcote, Nottingham. By a notice of decision dated 11 June 2026, the CQC cancelled that registration under section 17(1)(e) of the Health and Social Care Act 2008 and Regulation 6(1)(c) of the Care Quality Commission (Registration) Regulations 2009, on the ground that the provider had not carried on the regulated activities for a continuous period of 12 months or more. The notice was emailed on 11 June 2026 both to the care home and to the personal email address of Mrs Andrea Charlesworth, the company's nominated individual, so that the 28-day period under section 32(2) of the Health and Social Care Act 2008 expired on 10 July 2026. Mrs Charlesworth, who had not read the notice fully, sent the appeal application to the CQC's general enquiries address on 19 June 2026. Only on 23 July 2026 did she ask the Care Standards Tribunal for an update and learn that nothing had been received; the appeal application reached the Tribunal on 31 July 2026. Tribunal Judge Khan listed a preliminary hearing to decide whether time should be extended.
