Seerat Razzaq v Registrar of Approved Driving Instructors

Facts

The appellant, Seerat Razzaq, applied to the Registrar of Approved Driving Instructors for a trainee licence. The Registrar refused the application and the appellant appealed to the First-tier Tribunal (General Regulatory Chamber). The appeal was listed for a remote oral hearing by CVP on 22 July 2026, at which neither the appellant nor any representative of the Registrar participated; in section 10 of his Notice of Appeal the appellant had in any event ticked the box indicating that he wished his appeal to be determined without a hearing. On 6 August 2026 the office of the Registrar sent email correspondence to the General Regulatory Chamber enclosing a Form GRC5, the form by which a party requests a case management direction or decision, asking the Tribunal to strike the appeal out under rule 8(3)(c) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009 on the basis that it had no reasonable prospect of success. The Registrar's Administrative Officer explained that the appellant had failed his third attempt at the instructional ability test on 5 August 2026, so that any continuing rights were revoked and it had become unlawful for him to give driving instruction for reward. The correspondence and the Form GRC5 were copied to the appellant on the same day, and the Registrar indicated that it would consent to a withdrawal of the appeal if one were sought.
