The claimant lives at Manor House in the hamlet of Long Thurlow, Suffolk; the interested party lives in the adjoining property, Cadogan House. Badwell Ash Parish Council, whose area covers both Long Thurlow and the village of Badwell Ash, prepared a draft Neighbourhood Plan. There was a long history of planning decisions concerning land to the rear of Cadogan House: permission was refused and an appeal dismissed by an Inspector on 26 November 2019; a grant of permission on 5 October 2020 was quashed by consent on 17 December 2020 after the defendant accepted it had not taken the 2019 appeal decision into account; permission was refused in March 2021; and a grant of permission on 27 January 2022 for an outbuilding was likewise quashed by consent. During the pre-submission consultation the interested party, himself a parish councillor, sought a northward extension of the proposed Long Thurlow settlement boundary, which the Parish Council accepted. The Examiner, Ann Skippers, appointed in April 2025, reported on 8 August 2025 recommending modifications, and the defendant accepted her report on 18 August 2025. The claimant issued this judicial review on 6 October 2025, contending that four mandatory material considerations had been ignored. Lang J granted permission on 5 February 2026.
