Andrew Feldman v The Information Commissioner

Facts

The applicant, Andrew Feldman, made a data subject access request to AST Assistance Limited on 22 June 2025, seeking specific categories of personal data concerning him, including police communications, investigation records, witness material, litigation records, internal correspondence, disclosure records and audit logs. AST Assistance Limited disclosed no personal data, stating instead that the request was "vexatious" and threatening to refer further correspondence to the police. The applicant complained to the Information Commissioner on 18 June 2025, asking the Commissioner to consider whether AST Assistance Limited had complied with its obligations under Articles 12 and 15 of the UK GDPR and whether it was entitled to refuse the request. On 8 January 2026 the Commissioner responded that no further action would be taken and that a copy of the complaint would be kept on file. The applicant sought a review, and on 24 June 2026 a reviewing officer confirmed the decision was unchanged, explaining that the right of access is not absolute, that further regulatory action was neither necessary nor proportionate given the broader dispute, and that the applicant could seek legal advice or pursue the matter through the courts. By form GRC3 dated 9 June 2026 the applicant applied to the Tribunal under section 166(2) of the Data Protection Act 2018 for an order to progress the complaint. The Commissioner applied by form GRC5 dated 29 June 2026 to strike the application out.
