Facts
Barnaby Weston brought an appeal in the Transport jurisdiction of the First-tier Tribunal (General Regulatory Chamber), with the Registrar of Approved Driving Instructors as respondent. The judgment does not describe the decision under appeal or the appellant's grounds. It records only that he had passed Part 1 of the test on 16 July 2024. On 14 September 2026 the Registrar applied for the appeal to be struck out under rule 8(3)(c) of the Tribunal Procedure (First-tier Tribunal)(General Regulatory Chamber) Rules 2009. The Registrar's case was that, because the Part 1 pass dated from 16 July 2024, the appellant could no longer fulfil the condition in regulation 3(4)(c) of the Motor Cars (Driving Instruction) Regulations 2005. By a direction dated 18 September 2026, the Tribunal required the appellant to confirm by 2 October 2026 whether he wished to continue with his appeal. He was warned that a failure to do so could lead to his case being struck out. No response was received from him. The strike-out application was then determined on the papers, without a hearing.
