Facts
The appellant, Ho Ken Leung, appealed to the First-tier Tribunal (General Regulatory Chamber) against a decision of the Registrar of Approved Driving Instructors. Registration as an approved driving instructor depends on the qualifying process being completed within the period allowed, and the appellant had passed Part 1 of the qualifying examination on 23 May 2024. On 27 May 2026 the Registrar applied for the appeal to be struck out under rule 8(3)(c) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009, on the footing that, more than two years having elapsed since the appellant passed Part 1, he could no longer fulfil the condition contained in regulation 3(4)(c) of the Motor Cars (Driving Instruction) Regulations 2005. By a direction dated 14 July 2026, Judge Harris required the appellant to confirm by 29 July 2026 whether he wished to continue with his appeal, and warned him that a failure to do so could result in his case being struck out. No response was received from the appellant. The application was determined on the papers, without a hearing, on the material before the Tribunal.
