The claimants, Jacqueline Frances Gomes and Vasco de Oliveira Gomes, brought a claim in the London Circuit Commercial Court against AMG Financial Management Limited, Martin Lester Grey, Marco Mandelli and Rae Jonathan Bowdery. The claim had been issued in 2022 but, as the court noted, was stayed and nothing material happened for some three and a half years until Particulars of Claim were served shortly before the hearing. The third defendant, Mr Mandelli, a solicitor who had acted in person until Judge Sykes Frixou were instructed in late 2025, issued a suite of applications: for summary judgment, for a declaration that the claim disclosed no reasonable grounds, and, in the alternative, applications founded on abuse of process and on failure to comply. In the main judgment, published as [2026] EWHC 2284 (Comm), the Deputy Judge granted summary disposal of the claim against Mr Mandelli but rejected the abuse of process and failure to comply applications, indicating that the error in the claimants' addresses on the claim form would have been corrected under CPR 3.10 had the claim survived. The parties agreed most of the consequential order but could not agree costs, and invited the judge to determine costs on paper.
