Facts
The appellant, Mr Jahidur Rahman, had been an approved driving instructor, his name having first been entered in the Register of Approved Driving Instructors in May 2005 and removed on 1 June 2009 on expiry of his certificate of registration; his name was re-entered in the register in May 2025, with the certificate due to expire on the last day of May 2029. On 6 July 2025 he was arrested on suspicion of sexual assault on a female aged 13 or over, following a complaint by an adult female pupil that she had been sexually assaulted by him between 28 May 2025 and 4 June 2025, and was released on bail on condition that he was not in a vehicle unaccompanied with a female who was not a family member. West Midlands Police notified the Registrar of Approved Driving Instructors under the Common Law Police Disclosure on 8 July 2025, and the Registrar wrote the same day inviting representations within 28 days. None were received in time, and on 12 August 2025 the Registrar decided that the appellant had ceased to be a fit and proper person to have his name in the register under section 128(2)(e) of the Road Traffic Act 1988. The appellant appealed on 31 August 2025.
