Krzysztof Stanislaw Czapla v The Secretary of State for Work and Pensions

Facts

The claimant, Krzysztof Stanislaw Czapla, sought personal independence payment. By a decision of 5 March 2024 the Secretary of State for Work and Pensions awarded him 0 points for the daily living component and 0 points for the mobility component, so that he was not entitled to either component from and including 16 October 2023; that decision was reconsidered, but not revised, on 2 July 2024. His conditions included cirrhosis of the liver, causing abdominal pain, vomiting and dizziness, osteoarthritis in the left foot, pes planus deformity, a complex meniscal tear, rupture of the anterior cruciate ligament in the left knee and swelling of both lower limbs; he mobilised with an elbow crutch. He appealed. The First-tier Tribunal (Social Entitlement Chamber) sitting at Chesterfield, comprising Judge Hayes, Dr Wright and Mr Sher, heard the appeal on 25 July 2025, when the claimant attended with his representative and an interpreter and gave oral evidence; no presenting officer attended. The Tribunal awarded 4 points for the daily living component and 4 points for the mobility component, which left him entitled to neither, and refused the appeal. District Tribunal Judge Ennals granted permission to appeal on 24 November 2025. A further claim made on 12 November 2025 succeeded, so the appeal concerned only the closed period to 11 November 2025. The Secretary of State supported the appeal.
