Facts
The claimant, Nimeh Saleh, applied for personal independence payment. By a decision of 23 February 2024 the Secretary of State for Work and Pensions awarded her 4 points for the daily living component and 4 points for the mobility component, so that she was not entitled to either component from and including 26 November 2023; that decision was reconsidered, but not revised, on 23 May 2024. She appealed to the First-tier Tribunal (Social Entitlement Chamber), which heard the matter at Poole on 19 May 2025, the claimant attending with her partner, her representative and an interpreter and giving oral evidence; no presenting officer attended. The Tribunal allowed the appeal, awarding 9 points for daily living and 10 points for mobility, so that she was entitled to both components at the standard rate from and including 26 November 2023 to and including 26 November 2028. On 4 August 2025 District Tribunal Judge Bennett granted permission to appeal in relation to mobility activity 1, planning and following journeys; the appeal in relation to the daily living component was not pursued. The Secretary of State's submissions of 25 March 2026 supported the appeal. The Upper Tribunal decided the matter on the papers, neither party having sought an oral hearing.
