Facts

The claim is part of long-running litigation in which the first and fourth claimants (the Bourlakovas) sue the estate of Oleg Bourlakov and others, including the twelfth defendant, Edelweiss Investments Inc. A Mr Ploshchenko had brought an arbitration in Russia against Edelweiss which both sides regarded as bogus. On 17 November 2025 the court made a Disclosure Order requiring Edelweiss to produce arbitration documents to the Bourlakovas. The Bourlakovas gave undertakings limiting use of the documents and a cross-undertaking in damages. Paragraph (7) required Edelweiss to request the arbitral tribunal's permission for a transcript or recording of any hearing, and to provide it. The main judgment was published in redacted form under a later order. Unknown to the court, the tribunal had already permitted recording, but it twice refused Edelweiss permission to disclose the recording. It dismissed Ploshchenko's claim on 21 January 2026, and in its costs award it deducted $100,000 for Edelweiss's breach of arbitral confidentiality in complying with the Disclosure Order. Ploshchenko challenged the award. Separately, a Mr Korovin, who had been Ploshchenko's witness, began a similar arbitration against the second claimant, Hermitage One. Edelweiss applied for deletion of the documents, enforcement of the cross-undertaking and a postscript to the main judgment. The Bourlakovas sought compliance with paragraph (7). Hermitage One sought permission for collateral use of the documents.
