The appellant, Mr Remus Mihai Muza, is a Romanian national who was granted limited leave under Appendix EU to the Immigration Rules on 15 September 2020, expiring on 16 September 2025; the date of his arrival in the UK is not known and neither his witness statement nor his skeleton argument addresses it. On 26 September 2023 he was convicted at the Court of Milan of attempted blackmail, for conduct in Italy in December 2019, and sentenced to two years' imprisonment and fined €900. On 5 December 2024 he was convicted in the UK of six counts of shoplifting, receiving an 18-month suspended sentence with sundry non-custodial requirements, and of one count of battery, for which there was no separate penalty. A notice of liability to deportation under regulation 27 of the Immigration (European Economic Area) Regulations 2016 was served on 26 January 2025, to which he did not respond. On 13 March 2025 a decision to make a deportation order was taken and certified under regulation 33 of the 2016 Regulations, and the order was made on 18 March 2025. He appealed in time under regulation 36 of the 2016 Regulations. He did not attend the hearing at Taylor House and was unrepresented, his solicitors having come off the record in June 2026.
