Facts

The appellant, aged 35, was wanted by Poland for prosecution under an accusation Extradition Arrest Warrant (ExAW) dated 29 January 2026. He was arrested on the warrant on 4 February 2026. Box E of the ExAW asks for a description of the time, place and degree of the requested person's participation in the offence. It named the appellant and alleged that on 22 June 2025, in a multi-family building at 3 Lipnicka Street in Bielsko-Biala, acting jointly and in concert with other identified individuals, he inflicted blows and kicks with his hands, jumped on the victim's head and whole body, and inflicted two stab wounds with an 18cm bladed tool. Those injuries were said to have caused the victim's death. The warrant also alleged that the suspect then set fire to the flat where the body lay, and that he acted throughout with particular cruelty. On 21 May 2026 DJ King ordered extradition in a 29-page judgment. The judge held that the particulars were legally adequate under section 2(4)(c) of the Extradition Act 2003 and that the conduct described would amount to murder, so that an extradition offence was identified under section 10 of the Extradition Act 2003. Mould J refused permission to appeal on the papers, and the appellant renewed his application at an oral hearing.
