Facts

The appellant, Vince Bogdan, was sought by the Győr Regional Court in Hungary on a conviction warrant issued on 24 May 2022 and certified by the National Crime Agency on 22 November 2022, to serve the remainder of a total sentence of three years and fifteen days' imprisonment for offences committed between August 2009 and July 2015. The warrant covered two judgments: a Győr District Court judgment concerning a warehouse burglary in July 2015 with his nephew, and a Sopron District Court judgment concerning the unauthorised disposal of his landlord's furniture, the registration of eight individuals at his rented apartment without the landlord's permission, and two incidents of fixing incorrect registration plates to his cars. He had earlier been arrested in March 2018 on two previous warrants, extradition had been ordered in November 2018, and after those warrants were withdrawn the High Court discharged him on 28 November 2022. He was arrested on the present warrant on 20 December 2022 after voluntarily surrendering, and remained on conditional bail. District Judge Curtis heard the case on 24 July 2024 and on 16 August 2024 ordered extradition, finding the appellant a fugitive and rejecting his challenges. Collins Rice J granted permission to appeal on dual criminality only; the retrial and Article 8 grounds were listed on a rolled-up basis.
