Owen Glynn & Anor v Trevor Taylor & Ors

Mr and Mrs Glynn are the registered proprietors of 144 Hollin Lane, Middleton, Manchester, holding the leasehold title purchased in July 1981 and, in Mr Glynn's sole name, the freehold title purchased in April 2018. They applied to HM Land Registry under section 60 of the Land Registration Act 2002 for a determined boundary between 144 and the land adjoining it to the west. That adjoining freehold land belongs to the First and Second Respondents, Trevor Taylor and his brother David Andrew Taylor, who purchased in about June 2015 and who developed it to form a new road, Trevor Junior Close, together with several bungalows and a house. The Third and Fourth Respondents, Mr and Mrs Frohlick, hold the leasehold title to 1 Trevor Junior Close, adjoining the rear of 144, purchased in about February 2019. Mr Taylor objected to the application on 28 July 2023, and the matter was referred to the Tribunal; by an order of 13 November 2023 the Second, Third and Fourth Respondents were joined as parties. Fencing of long standing had divided the properties since before the 1981 purchase, but Mr Taylor removed it in 2019 and put up new fencing. The Second Respondent took no part, and the Frohlicks indicated they would abide by the Tribunal's decision. Both Mr Glynn and Mr Taylor appeared in person at a two-day hearing.
