The Properties in question are 2 Hawarden Avenue, Wallasey and 6 Knaresborough Road, Wallasey, registered since 1997 and 2005 respectively in the joint names of twin brothers Nicholas James Coombes and Andrew Kenneth Coombes. 2 Hawarden Avenue had been bought jointly as an investment and was Nicholas' home; 6 Knaresborough Road was the family home inherited with their brother Dale, whose share the brothers purchased, and was Andrew's home. Nicholas had been diagnosed with an incurable cancerous brain tumour in 2014. On 15 January 2024 he married Amanda Jane Ruth Coombes, and on 24 January 2024 the couple attended solicitor Gareth Davies, where Nicholas' will was executed and, on Amanda's case, notices of severance were drawn up and handed to Andrew that evening. Andrew denied receiving them. On 4 March 2024 the brothers executed TR1s transferring both Properties into Andrew's sole name. Further notices of severance were posted through Andrew's letterbox on 19 March 2024, and applications to enter notices of severance were lodged on 22 April 2024, two days after Nicholas died. Andrew objected, and the matter was referred to the First-tier Tribunal, where Amanda, as executor, also applied to set aside the Transfers.
