The applicant, Tanya May Davies, is the registered proprietor of 34 High Street, Aberystwyth, and of the first and second floors of the adjoining land, which the respondents transferred to her in 2005. The respondents, David Gary Jones, Wayne Jonathan Jones, Eileen Jones and Susan Jones-Evans, are the registered proprietors of 51 Bridge Street, which backs directly onto 34 and whose title comprises the house, an area of open land to the rear and a ground floor passageway leading onto High Street. On 31 January 2023 the applicant applied to HM Land Registry under paragraph 1 of Schedule 6 to the Land Registration Act 2002 to be registered as proprietor of approximately the half of the open land nearest to 34, excluding the passage and a shed. Her case was that she had maintained the land and used it as a garden since moving into 34 in 1997: fencing or marking the boundary, storing building materials, creating a firepit, clearing rubbish and padlocking the passage door. The respondents objected on form NAP, denying that her acts were sufficient. The matter was referred to the Tribunal on 20 March 2025 and heard at Aberystwyth Justice Centre, the applicant appearing in person with assistance from Mr Philip David Tecwyn Williams.
