Vasile Barbu v The Secretary of State for the Home Department

The appellant, Vasile Barbu, is a Romanian national who came to the United Kingdom in November 2002 to work as a chef at the Old Pandy public house, later becoming its owner in 2017 until it was sold in 2023. He met his wife, Maria, in 2003; they married on 4 December 2004 and have twin children born in the United Kingdom on 17 September 2004. On 2 June 2022 he was driving his van on the A40 dual carriageway between Abergavenny and Raglan, en route to Calais to deliver parcels, when he collided with the rear of a bicycle ridden by Mrs Rebecca Comins, who was taking part in an organised time trial. She died at the roadside. A vehicle examination found the van was not in a fit state to be on the road and was overloaded. Following a trial at which he did not give evidence, he was convicted of causing death by dangerous driving and sentenced by Judge Khan to four years' custody. He was also convicted on 23 February 2023 of miscellaneous offences arising from a Food Standards Agency inspection of his pub. The Secretary of State made a deportation decision on 10 April 2025, which he appealed on human rights grounds to the First-tier Tribunal.
