Bendac Labs Limited v The Pensions Regulator

Facts

Bendac Labs Limited, the appellant, lodged an appeal with the First-tier Tribunal (General Regulatory Chamber) against The Pensions Regulator using the GRC1 form on 1 July 2026. The appeal as lodged was incomplete: the appellant did not include a copy of the decision notice it sought to challenge, without which the Tribunal could not identify the decision under appeal. By Directions and an accompanying email dated 3 July 2026 the appellant was required to provide a copy of the Decision Notice it wished to challenge to the Tribunal within 28 days. The appellant did not comply with that Direction. Further Directions dated 27 July 2026 directed the appellant to provide a copy of the Decision Notice by 7 August 2026, and the appellant was directed to note that a failure to comply could lead to the Tribunal striking out the appeal for failure to comply without further direction. The appellant again failed to comply with the Direction dated 27 July 2026. The matter came before the Tribunal for determination without a hearing, the question being whether the appeal should be struck out for that non-compliance.
