Car Service Hamzaj Ltd v The Pensions Regulator

Facts

Car Service Hamzaj Ltd appealed to the First-tier Tribunal (General Regulatory Chamber), Pensions jurisdiction, against a decision of the Pensions Regulator. The appeal was lodged using the GRC1 form on 26 May 2026, but the notice of appeal was incomplete: it did not contain a completed statement of truth and no copy of the decision notice under appeal was provided. On 28 May 2026 the Tribunal issued directions and an email informing the Appellant that the appeal did not comply with the relevant requirements and directing it, within 14 days, to submit a compliant notice of appeal with all required information and documentation. The Appellant did not comply. Further case management directions were issued on 23 June 2026, this time by Judge Muzaffer, requiring the Appellant to provide a completed GRC1 form and the decision notice with a right of appeal by 9 July 2026, and expressly warning that failure to comply could result in the appeal being struck out pursuant to rule 8(3)(a) of the applicable procedural rules. The Appellant again failed to comply, and the required documents were never provided. The matter was determined by Tribunal Judge Kiai without an oral hearing, on the papers, on the question of whether the appeal should be struck out for that continuing non-compliance.
