Michael Peter Munro is the registered proprietor of 5 Burnham Road, Epworth, Doncaster, title number HS334872. Direct UK Marketing Limited, trading as "Stop Repossession Experts", applied to HM Land Registry to enter a unilateral notice in respect of an equitable charge over the property, dated 6th November 2023 and securing a fee expressed as a fixed percentage of the market value or sale price of the property, together with interest. The company's case was that Mr Munro had approached it, through an online enquiry form and by telephone, because he feared repossession by his equity release lender following an enforcement notice from the council, and that it had put him in touch with solicitors and estate agents. Mr Munro objected, and the matter was referred to the Tribunal on 24th November 2025. He was designated the applicant, the burden being on him to show that the charge, valid on its face, should not be registered; he also completed a form T410 confirming that he applied to set the charge aside. He contended that the company had approached him, had done nothing for him, that he had not understood what he signed, and that he had signed under duress.
