Sajad Ahmed v Gulnaz Begum Nawaz & Ors

Facts

The dispute concerned two Bradford properties within one family: 2 Beechwood Grove, the family home registered under title number WYK223899, and 106 Canterbury Avenue, a rental property registered under title number WYK97066. The applicant, Sajad Ahmed, was represented throughout by his son Kamran, to whom he had granted power of attorney. By a TR1 dated 7 April 2022 Sajad and his wife Gulnaz transferred Beechwood Grove to Gulnaz and their daughter Saila for no consideration, Sajad in effect gifting his interest to Saila. By a TR1 dated 14 April 2022 Sajad transferred Canterbury Avenue to Saila for £100,000, she purchasing with a mortgage from Accord Mortgages Limited. Sajad contended that he had signed neither TR1 and that his signatures had been forged, his case being that marital difficulties had caused him to leave the family home on 23 March 2022, before the transactions, and that Gulnaz and Saila had taken his telephone and colluded to obtain his assets. He applied to alter the register in respect of Beechwood Grove and objected to Saila's application to register the Canterbury Avenue transfer and to Accord's application for a unilateral notice. Four references were made to the Tribunal by HM Land Registry on 20 May 2023 and heard together.
